Terms of Service

1. Agreement to Terms
By accessing or using any service provided by FastFlowTech ("we", "us", "our") - including the FastFlowTech website at fastflow.tech, FlowPrime, and all products in the FastFlowTech ecosystem (collectively, the "Service") - you agree to be bound by these Terms of Service ("Terms").
If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
If you do not agree with these Terms, do not use the Service.
2. Description of Service
FastFlowTech provides a suite of SaaS products accessible through individual subscriptions or the FlowPrime bundle. Our products run on shared infrastructure, including authentication (ALKEYON), billing, analytics, and hosting services.
Each subscriber ("Tenant") receives isolated databases and dedicated resources within our shared infrastructure. While databases are isolated, compute resources (CPU, memory) and network bandwidth are shared across tenants on the platform.
3. Account Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately of any unauthorized use of your account.
- You must be at least 16 years of age to use the Service.
4. Subscriptions and Billing
4.1 Plans and Pricing
The Service is offered through paid subscription plans, including FlowPrime (bundled access to all products) and individual product subscriptions. Current pricing is available on our pricing page.
4.2 Payment
Payments are processed through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis according to your chosen billing cycle (monthly or annual). All fees are in USD unless otherwise stated.
4.3 Refunds
Subscriptions may be cancelled at any time. Upon cancellation, you retain access through the end of your current billing period. We do not provide prorated refunds for partial billing periods. If you believe a charge was made in error, contact us within 30 days.
4.4 Price Changes
We reserve the right to change pricing with 30 days' notice. Existing subscribers will be notified by email before any price change takes effect on their next billing cycle.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party rights
- Distribute malware, viruses, or any harmful code
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the integrity or performance of the Service
- Use the Service for cryptocurrency mining, torrent hosting, or proxy services
- Send unsolicited bulk communications (spam) through our platform
- Scrape, crawl, or harvest data from the Service through automated means without authorization
- Resell, sublicense, or redistribute access to the Service without written agreement
- Use bots, scripts, or automated tools that place excessive load on shared infrastructure
- Store or transmit illegal, defamatory, or infringing content
6. Resource Monitoring and Fair Use
Our products run on shared infrastructure. To ensure a reliable, fast, and fair experience for all users, we actively monitor resource consumption across the platform. This section describes how we do it and what it means for you.
6.1 What We Monitor
We continuously monitor the following metrics at the tenant level:
- Database size - storage consumed by your tenant's isolated database(s)
- CPU usage - compute resources consumed by your account's operations
- Memory usage - RAM consumed by your account's active processes and cached data
- Bandwidth - network traffic generated by your account, including API calls and data transfers
This monitoring is automated and designed to detect anomalies, prevent abuse, and protect the platform from bad actors and bots - not to penalize normal use.
6.2 How We Use This Data
We regularly review resource consumption across all tenants. Specifically:
- We identify the top 20% of resource consumers across any monitored metric for review and trend analysis.
- For accounts in the top 1% of resource consumption, we reserve the right to reach out to discuss your usage and, where appropriate, recommend a move to an Enterprise plan that provides dedicated resources suited to your workload.
6.3 Enforcement
If your account consistently consumes resources at a level that degrades the experience for other users:
- We will contact you to discuss your usage and explore options (e.g., optimization guidance or an Enterprise plan with dedicated resources).
- If we are unable to reach you, or if you are unresponsive or uncooperative after reasonable attempts, we reserve the right to throttle, suspend, or terminate your account to preserve the performance and stability of the platform for all other users.
- Before termination, we will make reasonable efforts to notify you and provide an opportunity to export your data.
Our commitment: We are transparent about this because we believe you deserve to know how shared infrastructure is managed. The vast majority of users will never be affected by these policies. They exist solely to prevent a small number of accounts - whether through abuse, misconfiguration, or bot activity - from degrading the service for everyone else.
7. Data Ownership and Intellectual Property
7.1 Your Data
You retain all rights to the data you create, upload, or store in the Service ("Your Data"). We do not claim ownership of Your Data. We access Your Data only to provide and maintain the Service, as described in our Privacy Policy.
7.2 Our Intellectual Property
The Service, including all software, design, branding, documentation, and underlying technology, is owned by FastFlowTech and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.
7.3 Feedback
If you provide suggestions, ideas, or feedback about the Service, we may use them without obligation or compensation to you.
8. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:
- Scheduled maintenance (we will provide advance notice when possible)
- Emergency maintenance or security patches
- Events beyond our reasonable control (force majeure)
We do not provide SLA guarantees on standard plans. Enterprise plans may include specific uptime commitments negotiated separately.
9. Termination
9.1 By You
You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period.
9.2 By Us
We may suspend or terminate your account if you:
- Violate these Terms or the Acceptable Use policy
- Fail to pay fees when due
- Engage in activity that threatens the security or stability of the platform
- Are unresponsive to resource usage communications as described in Section 6
9.3 Effect of Termination
Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after termination to allow you to export it. After 30 days, your data will be permanently deleted.
10. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
- We do not warrant that the Service will be error-free, secure, or uninterrupted.
- In no event shall FastFlowTech be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
- Our total liability for any claim arising from these Terms or the Service is limited to the amount you paid us in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold FastFlowTech harmless from any claims, losses, or damages (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
12. Governing Law
These Terms are governed by the laws of New Zealand. Any disputes arising from these Terms or the Service shall be resolved in the courts of New Zealand.
13. Force Majeure
Neither party shall be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond its reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, internet or infrastructure outages, or power failures.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email and by posting the updated Terms on this page. Continued use of the Service after changes constitutes acceptance.
For material changes that affect your rights or obligations, we will provide at least 30 days' notice before the changes take effect.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
